Foundation for Kentucky’s Future, Inc. seeks recusal of special justices appointed by Governor - Mark Nicholas of the Foundation for Kentucky’s Future, Inc. filed a complaint with the Judicial Conduct Commission against two special Justices appointed by Gov. Ernie Fletcher who will be hearing the appeal of Franklin Circuit Judge William Graham’s ruling regarding the practices to be allowed by the Franklin County Grand Jury which is investigating the Merit System allegations. The appeal of Judge Graham’s ruling will be heard by the Ky. Supreme Court in March.
Chief Justice lambert and Justice Roach have both recused themselves, and under the Ky. Constitution the Gov. appoints special justices to hear cases in which two justices have recused. Nicholas has posted the complaint on his web site at BluegrassReport.org. The entire complaint is posted and can be accessed by going to http://www.bluegrassreport.org/Recusal.doc.
Nicholas maintains in the complaint that while the Governor can appoint anyone he wishes to the Supreme Court, that the justices appointed have an obligation under the Judicial Conduct Code to recuse themselves if their hearing of the case would create the appearance of impropriety. Nicholas alleges that each have made campaign contributions to the Governor in past campaigns.

Chief Justice Joseph Lambert said the state constitution already "clearly defines" the roles of the judicial, legislative and executive branches. "I question the desirability of new constitutional sections that might disrupt the traditional separation of governmental powers," he said.
Retired state Supreme Court Justice John Palmore said the amendment may violate the U.S. Constitution by limiting the rights of people to seek redress in courts. He said he believed the bill was a Republican ploy to mobilize "the bigots" in this year's elections. "I think it's a redneck project entirely," he said.
