COUNTY LAW LIBRARIES CAN PROVIDE LEGAL RESEARCH RESOURCES TO JUDGES AND PROSECUTORS

 

In 2005 the legislature vastly increased the funding of County Law Libraries.

 

In 2007 the Legislature approved sharing of County Law Library resources with the local Public Library.  (HB 273). 

 

Wide discretion is given to the Trustees of the County Law Library in the selection of materials for the library. The new law (HB 273). specifically allows the purchase of online resources such as LawReader.

 

KRS 172.110 requires that access to the County Law Library be provided to county and state officials. This includes judges, prosecutors and the County Judge-Executive.

 

The law also mandates that the library be accessible “at reasonable hours each day except Sunday and holidays.”   Since almost all County Law Libraries are closed on Saturdays, they are in violation of this mandated duty.

 

One solution to this access problem is for the County Law Library to purchase a subscription for their local judges, and prosecutors.  Some counties are already doing this.

 

Many counties are in multi-county judicial districts.  This suggests that even rural counties could band together to fund subscriptions for the judges they share.
